Terms and Conditions effective from 1 October, 2018
General rules
These Terms and Conditions of Online Training Services apply to all online training services provided by UAB “FL Technics” (hereinafter – “FL TECHNICS”).User's Standard Contract Terms and Conditions are not applicable. Deviations from these Terms and Conditions of Online Training Services need to be agreed in writing.
Purchase of particular online training shall be treated as acceptance of these Terms and Conditions of Online Training Services and execution of the Contract between FL TECHNICS and user (hereinafter – the “Contract”) based on such terms and conditions.
Pursuant to Commission Regulation (EC) No 2042/2003, the Civil Aviation Administration of the Republic of Lithuania approved FL TECHNICS as Part-147 maintenance training organization.
Online Training (hereinafter the Online Training or the Website) website at 147training.com is designed to provide training-related information, acquire and learn at distance learning courses in the e-environment.
The website is supported and coordinated by FL TECHNICS.
FL TECHNICS reserves the right to change, modify, add or remove these Rules, however, undertakes to announce information about the changes on its Website.
Privacy policy
Any personal information submitted through the use of the ONLINE TRAINING Website is managed according to the FL TECHNICS Privacy policy.
All user information collected on FL TECHNICS Website is confidential and protected from unauthorized use. No information will be passed to any third party without the user's consent other than in cases specified in the legislation of the Republic of Lithuania.
By registering, the user agrees to comply with the Website rules and agrees that his access can be blocked in case of breach of the rules.
Like many websites, we monitor the traffic and collect information about the number of visitors, the name of the visitors’ internet service provider's server domain (domain) (IP), etc. This information is collected automatically, during your visit of the Website. It helps to understand how visitors use the Website and provides the opportunity to improve our services.
Services on the ONLINE TRAINING website
ONLINE TRAINING offers users the following options:
a) Free registration for individual users:
· Purchase of the offered distance learning courses in the online store.
· Receive notifications regarding courses, as well as other course-related information by email
· Seminar-related questions to trainers and answers within 1-2 working days.
· Taking notes during the workshops on each topic;
· Receive an electronic or hard copy certificate (hereinafter the Certificate), confirming the listening of the video seminar and the information acquired. (A hard copy of the Certificate is ordered separately at an extra fee);
b) Additional functions provided to the companies:
· Storage of qualification files and all documents
· Ending date (training and documentation) tracking tool
· Various mass course handouts to groups
· Progress tracking of learner groups
User registration on the ONLINE TRAINING Website, obligations and rights
Trainings are available for registered users only.
Individual user registration is freely available to everyone. For companies with additional functionality, the access is provided only upon additional contacting by [email protected], or using the online form https://147training.com.
All personal data of the registered ONLINE TRAINING users are protected in accordance with the laws of the Republic of Lithuania.
User is responsible for compliance with any requirements for participants' qualifications. The requirements for participation as set forth in the training programs shall apply. During the registration the user undertakes to provide only the correct and complete login details. The user is not allowed to sign in using not authentic information. FL TECHNICS has the discretion to decide on the correctness, completeness and accuracy of the user login details. Should the user provide false, incomplete or inaccurate data, FL TECHNICS has the right to immediately and without notice to the user, to deny his registration, and remove the user from the registration list.
The user is responsible for accurate data presentation/entry and the certificate issued on their basis.
In case of a forgotten password, the user must send a message to FL TECHNICS administration for password update in the Website authorization window, clicking the link "Forgot password?". A new password will be sent to the user at his email address indicated in the registration form.
The administration of FL TECHNICS has the right to cancel the user's account without the user's consent if the user fails to comply with or violates the terms of use of FL TECHNICS. In this case, all personal user's data will be deleted.
The Website may use cookies. A cookie is a small text document, with a unique identification number, which is transferred from this Website to your computer's hard drive. Cookies are used to identify your computer and facilitate your access to this Website or the information contained therein. Most web browsers accept cookies, but you can change your browser settings so that cookies are not accepted. In this case, some Website functions may not work.
Miscellaneous
In order to get the certificate, the ONLINE TRAINING user must learn the training material before the submission of answers.
If User requires examination (if applicable for training course) to be performed not in Online environment, it is possible to order and perform it in approved examination centers, at User’s or FL TECHNICS’ premises for additional payment.
The preparer of materials is responsible for the contents of the materials hosted on the Website of FL TECHNICS and its compliance with the requirements of the regulations of the Republic of Lithuania.
By creating an account, the user confirms that he agrees to all terms and conditions of provision of services as stated herein.
All disputes arising between FL TECHNICS and the users of this Website for compliance with these Conditions shall be resolved by negotiation. In cases where the disputes cannot be resolved by negotiation, they will be dealt with in accordance with the current regulations of the Republic of Lithuania according to the respective normative acts.Place of jurisdiction shall be Vilnius, Lithuania.
Pricing
Unless otherwise stated, all fees are quoted in EUROS. The user is responsible for paying all fees in a timely manner with a payment accepted by the Website.
If your payment method fails or your account is past due, we may collect fees using other collection mechanisms.
https://147training.com reserves the right to change the fees at any time in its sole discretion. Any change, update, or modification will be effective immediately upon posting on our Site.
Despite our best efforts, a small number of the training in our catalogue may be mispriced. We will verify pricing when processing your order and before we take payment. If we have made a mistake and training's correct price is higher than the price on the Website, we will, at our discretion, either contact you to request whether you want to buy the training at the correct price or cancel your order.
Payment Methods and Money refund policy
Our accepted payments policy gives convenient payment options.
Acceptable payments methods: Credit card, Bank transfer, PayPal, Webmoney. Payment must be made in 14 days from invoice date.
In case of payment by credit card provided by our partner MangoPay you are accepting their terms and conditions uploaded here.
In case of payment by bank transfer, all and any bank charges and costs are on the account of user and all payments to FL TECHNICS have to be made without any set off to FL TECHNICS’ bank account.
Training course can be commenced only after payment in full has been received by FL TECHNICS.
If you are unable to complete the course or the course was canceled / removed from market place, you will be given a course coupon for paid amount valid for one year from the date of issue.

2. Email address to which you are registered in the FL TECHNICS system
3. Invoice and payment confirmation
We undertake to send coupon within 14 days after receipt of written request.
ATTENTION! If we see any abuse, we reserve the right to remove you from the system after one warning.
Liability/ Safety Rules
FL TECHNICS shall not be liable for any kind of damage arising directly or indirectly out of or in connection with the performance or non-performance of the Training, unless such damages have been caused by the gross negligence or intent of FL TECHNICS's or its directors, officers, employees and agents. User shall abide by the relevant safety and accident prevention rules applicable for Training within FL TECHNICS and its affiliates. User shall be liable for any kind of damage to and / or loss of property (including any aircraft), for which user, its officers, employees, agents or the training participants registered by user are responsible. User will hold harmless and indemnify FL TECHNICS from and against any claims brought by third parties in connection with the Contract, unless such claims are due to FL TECHNICS’s gross negligence or intent.
Personal Data Processing
User has presented or will present to FL TECHNICS his personal data (e. g. (a) identification data: name, surname, personal identification number, identity document number, image, and etc.; (b) contact details: address, telephone number, e-mail address, and etc.; (c) details of User’s licenses, qualification, education, work experience, trainings, abilities; (d) financial data: bank name, operating account number; (e) e-mail correspondence, as well as any other information, which may be necessary in conclusion, performance and administration of the Contract) under the Contract, in performance of the Contract or in connection with it.
FL TECHNICS shall also have the right to additionally collect data about the User that was made public by the User and its representatives (in registers, websites, public databases, etc.) and process it and use it otherwise for the purposes, on the grounds, under the terms, conditions and procedure set forth herein.
FL TECHNICS shall have the right to accumulate, share, analyse and systemise personal data indicated hereinabove in its information systems, contact information base, CRM base, other databases, systems, programs to the extent necessary for the purposes indicated hereof below.
FL TECHNICS shall process personal data indicated hereinabove for the following purposes and on corresponding legal grounds: (a) for conclusion, performance, administration, support of this Contract; (b) for creation, development, improvement of business and related legal interest of FL TECHNICS improvement of activities performed, services provided under the Contract and their quality; (c) for defending itself from statements of claims or other demands, for exercise of rights of FL TECHNICS; (d) for fulfilment of obligations imposed on FL TECHNICS by applicable legal acts; (e) for direct marketing services; also
FL TECHNICS shall protect and store personal data indicated hereinabove throughout the effective term of the Contract, also after its end – as long as necessary in order to defend itself from statements of claims or other demands, in exercise of FL TECHNICS’ rights, also in fulfilment of obligations imposed on FL TECHNICS or its employees, representatives by applicable legal acts, also to the extent necessary for the purposes of backup copies, business continuity purposes, unless the User consents to longer retention of personal data.
Personal data indicated hereinabove can be presented to the following data processors: FL TECHNICS subsidiaries; public authorities by request of these bodies or in other cases stipulated in regulations; Civil Aviation Administrations of other countries, including those beyond the European Economic Area; during audits; companies providing services of data centres, brand hosting, cloud computing, website administration and related services; companies providing advertising, marketing services; companies that create, provide, support and develop software; companies providing information technologies infrastructure services; companies providing communication services; consulting companies; companies that carry out internet browsing analysis and analysis of activities on the Internet and provide related services.
Personal data indicated hereinabove may be presented for the Contract performance and related purposes to partners, suppliers, other data recipients (including related companies), established and/or carrying on activities outside the European Economic Area. In non-EEA countries personal data can be subject to less strict personal data protection than in the EEA countries. FL TECHNICS shall ensure that personal data will be transferred only if there is a sufficient basis for this under the GDPR and other applicable legal acts – such data transfer may be necessary for conclusion and performance of this Contract (Article 49(1)(b) of the GDPR), it may also be based on other grounds, conditions and exceptions listed in Articles 46 – 49 of the GDPR. FL TECHNICS shall take reasonable measures in order that data processors and recipients would process received data in accordance with the GDPR and other mandatory legal requirements (among other things, if necessary, FL TECHNICS shall make a data transfer agreement in accordance with the standard data protection terms approved by the European Commission).
User must properly inform all natural persons whom it involves for performance of the Contract, also whose data it discloses for performance of the Contract and whose data it transfers to FL TECHNICS, about transfer of their personal data to FL TECHNICS, about processing of their data on the grounds, under terms, procedure and terms set herein. The said persons must be informed before transfer of their data to FL TECHNICS. The presented information should, inter alia, include the identity and contact information of FL TECHNICS, as the data controller, personal data processing purposes, personal data categories, legal basis for processing, retention period, data recipients, including those outside the EEA, and rights one has under the General Data Protection Regulation (EU) 2016/679.
Taking into account restrictions imposed by legal acts, User who is natural person has the following rights in connection with personal data processing: to get access to processed personal data; to demand correction of incorrect, inaccurate or incomplete data; to withdraw at any time their consent to personal data processing; to object to personal data processing, when that is done on the basis of a lawful interest and in other cases provided for in the General Data Protection Regulation (EU) 2016/679; to demand deletion of personal data or restriction of its processing; to request transfer of personal data to another data controller or its direct presentation to the User in a convenient form; when data is processed in breach of requirements of legal acts, User contacts FL TECHNICS immediately using the contacts specified below. In such a case User will also be entitled to lodge a complaint to the State Data Protection Inspectorate (more info on https://www.ada.lt/). User should always contact FL TECHNICS before lodging a complaint, so as to find a proper solution together. User in order to exercise the rights specified above of has other questions related to processing of personal data, contacts FL TECHNICS’ data protection officer or a responsible person by e-mail: [email protected] or by post: FL Technics, UAB, Rodunios kelias 18, LT-02188 Vilnius, Lithuania.
The provisions of this section mutatis mutandis shall also apply to the User according to the principle of reciprocity if and to the extent FL TECHNICS transfers relevant data of its employees and representatives to the User for the purposes of performance of this Contract and related purposes.
